Crystal Lake DUI License Suspension

Crystal Lake DUI License Suspension

Facing a DUI license suspension in Crystal Lake can be overwhelming, but understanding the process can help you take the right steps toward reinstating your driving privileges.

If you’ve been charged with a DUI, your license suspension is likely a consequence of either a failed or refused chemical test or a conviction. Here’s what you need to know about navigating this situation.

Understanding DUI License Suspension in Illinois

In Illinois, DUI-related license suspensions generally fall under two categories:

  1. Statutory Summary Suspension – This occurs when a driver is arrested for DUI and either fails or refuses a breath, blood, or urine test. Even if you are not convicted of DUI, the suspension will still take effect.
    1. Failed test: A first offense results in a six-month suspension, while a second offense within five years leads to a one-year suspension.
    1. Refused test: A first offense results in a one-year suspension, and a second offense within five years leads to a three-year suspension.
  2. DUI Conviction Suspension – If convicted of DUI, your license will be revoked, requiring a more complex process to regain driving privileges.

How to Fight a DUI License Suspension

A DUI suspension is not automatic and can sometimes be contested. Here are a few steps to consider:

  • Request a Hearing or Motion in Court: You have the right to challenge a statutory summary suspension through an administrative hearing. However, you must act quickly, as there is a limited window to request this hearing after your arrest.
  • Check for Procedural Errors: Law enforcement must follow strict procedures when conducting DUI stops and chemical tests. Any errors in their process could provide grounds to contest the suspension.
  • Seek a Monitoring Device Driving Permit (MDDP): If this is your first offense, you may be eligible for an MDDP, which allows you to drive with a Breath Alcohol Ignition Interlock Device (BAIID) installed in your vehicle.

Reinstating Your License After Suspension

Once your suspension period is over, you must take the necessary steps to reinstate your driving privileges. This typically includes:

  1. Paying a Reinstatement Fee: Illinois requires a reinstatement fee before your license can be reissued.
  2. Completing an Alcohol Education Program: Depending on your case, you may need to complete an approved substance abuse program.
  3. Attending a Secretary of State Hearing: If your license was revoked, you’ll need to attend either an informal or formal hearing to demonstrate your eligibility for reinstatement.

Working with John and his office was a great experience. I was revoked for 20 years and not sure where to begin when I was referred to John. I knew this the best attorney to work with after my first call with him. They scheduled my hearing and setup a new assessment for me right away. We met at his office a couple weeks prior to my hearing to review my assessment, documentation and testimony. On the day of the hearing, the officer was pushy and told us in the first two minutes that I would likely need a permit before being approved for reinstatement. John immediately defended me and all the work I had done to meet the requirements. After the hearing I was told we would get a decision within 6-8 weeks. 28 days later I received an email granting full reinstatement and the following day (today) I left the DMV with a license. Thanks John & team, you changed my family’s life!

John M Quinn & Associates made a very difficult time very easy. Everything that he said would happen happened. I would recommend him to anyone who is facing difficult times with the Illinois Secretary of State. Even though I live in Texas now. The whole process was very easily handled with his help. John M Quinn is very knowledgeable about how the Illinois Secretary of State works and what is required for driving privileges reinstatement. Thank you again for helping me get my driving privileges back after more than 17 years of not having them.
